Who you are agreeing with
Your agreement is with Kindsay. Reach us at support@kindsay.com. Using the site or an account means these terms apply to you; if you do not accept them, do not use the app.
Paying is the one part that runs through someone else. Plans are sold through Link, the payments service from Stripe, which acts as the seller of record: it takes the payment, charges the VAT, sends your receipts and invoices, and handles refunds. Your receipt and your card statement will say Link. The lessons themselves — the app, the speakers, the reports — come from us, and so does everything else on this page.
What Kindsay is — and is not
Every speaker in the app is a character generated by software. Harper, Charlotte, Tyler and the rest are not real people, not teachers, and not native speakers you are being introduced to.
The app has them hold a conversation with you, listens to your English, and writes corrections and a report afterwards. Those corrections are produced by an AI model. They are usually right and they are sometimes wrong — treat them as a well-read practice partner, not as an examiner. Nothing here is a qualification, a certificate, or preparation guaranteed to pass any exam, and we do not promise that your English will improve by any particular amount or by any date. That part is still down to you.
Your account
- You need to be at least 16 to have an account.
- An account belongs to one person. Use a real email address you can receive mail at — it is how you sign in and how we reach you.
- Keep your password to yourself. What happens under your account is your responsibility, so tell us straight away if you think someone else is in it.
- You can delete the account whenever you like, from Profile → Delete account. It takes effect immediately and it is not reversible.
Learning with a partner
You can invite one other person to join your lessons. They sign in with their own account and their own progress, and they join your lessons free — a lesson costs the same to run whether one person or two are talking. The flip side is that the minutes come out of the account of whoever started the lesson, once, no matter who was in the room. Someone who wants to practise alone needs their own plan.
Hours and plans
Payments are not open yet. While the app is in its waitlist phase nothing can be bought and no card is charged — this section describes what happens when the doors open.
Every new account starts with 5 free minutes, usable for 30 days from sign-up, once per person. No card is needed for them, and nothing is charged when they run out: the call simply stops until you choose a plan.
There are three plans, and they are all measured in the time you actually spend talking. Every price is set in euro (EUR) and includes VAT. The checkout may show you the equivalent in your own currency; if it does, that is the amount you pay, and you see it before you confirm:
- €2 a month — 1 hour a month.
- €7 a month — 4 hours a month.
- €12 a month — 8 hours a month.
A month's hours are for that month. Unused hours do not roll over into the next one, and they cannot be transferred to another account. Only time in a live lesson is counted: reading your report, browsing scenarios and sitting on the home screen are free.
A subscription renews every month until you cancel it. Cancel from Profile at any time — it keeps running until the end of the period you have already paid for, and then stops. We can change prices, but not retroactively: a change is announced by email and applies from your next renewal, and if you do not want it, cancel before then.
You can change plans on Profile. Moving to a bigger plan starts a new month that day: you pay the new plan's full monthly price, get its hours straight away, and your renewal moves to that day of the month. Nothing is credited for the old plan; instead, the minutes you had left stay usable until the end of the period they came with. Moving to a smaller plan costs nothing that day: the new price is charged from your next renewal, and the minutes you already have stay until then.
Refunds and the 14-day withdrawal right
As a consumer in the EU you can withdraw from a purchase within 14 days of making it, without giving a reason. For a subscription the 14 days run from the first payment, not from each renewal. An upgrade you pay for on Profile is a purchase of its own: you can withdraw from it within 14 days of paying for it, on the same terms.
Lessons are available the moment you pay. If you asked for them to start straight away and then withdraw within the 14 days, you get back what you paid minus the share you already used — for example, 15 minutes of the 1-hour plan's month means three quarters of the price comes back. If you have not used anything, you get it all back.
To withdraw, tell us: email support@kindsay.com from the address on your account, or ask Link through support.link.com. Any clear statement is enough; you may use this model form, but you don't have to:
To Kindsay, support@kindsay.com: I hereby give notice that I withdraw from my contract for the following service: [plan], ordered on [date], by [name], [account email]. Date: [date].
The refund goes back to the card or account you paid with, within 14 days of your notice, and costs you nothing. Outside the 14 days, if you have bought something and not used it, or the app did not work and you paid anyway, write to us — we would rather refund you than argue.
Using it fairly
Don't do the obvious things:
- No sharing an account between people, and no reselling access or the lessons, scenarios and corrections you find in it.
- No scripting, scraping or automating the app, and no working around the rate limits or the minute counting.
- No using the speakers to generate abusive, illegal or harmful material, and nothing that puts other people's data into the app without their knowing.
If an account is doing these things we may suspend or close it. Where the problem looks like a mistake rather than an attack, you will hear from us first.
Who owns what
The app, the speaker characters, the scenarios, the lessons and the exercises are ours, and a subscription is permission to use them, not to copy or republish them. What you say is yours — we keep the transcripts and corrections only to run the app and show you your own progress, as the privacy page sets out. We do not claim any right to use your recordings, and could not: there are none.
Early software, honestly
Kindsay is new and small. A speaker will sometimes say something odd, and features will change over time. Short interruptions happen and we fix them as fast as we can.
What you pay for has to work the way these terms and the site describe it. If it does not, the law — the Polish Consumer Rights Act and the EU rules on digital services — gives you these remedies, and nothing on this page takes any of them away:
- Put right. You can ask us to fix it, and we do so within a reasonable time, free of charge.
- Price cut or money back. If we can't or don't fix it, if it keeps happening, or if the problem is serious, you can have the price reduced in proportion, or end the contract and get back what you paid for the time the app did not work.
On top of that, we remain liable as the law says for anything we cause deliberately or through gross negligence, and for death or personal injury.
Complaints
If something is wrong — a lesson that broke, minutes counted that you did not use, a feature that does not do what it says — email support@kindsay.com from the address on your account. Tell us what happened, roughly when, and what you would like: a fix, minutes back, a price cut or a refund. Nothing else is required, and no form.
We answer every complaint within 14 days. If we don't answer in that time, your complaint counts as accepted. If we turn it down, we say why and what you can do next (see Law and disputes below). A complaint only about a charge, a card or a receipt can also go to Link at support.link.com.
Ending it
You can stop at any time by cancelling your plan or deleting your account. We may end an account that breaks these terms, or close the service entirely with reasonable notice — in which case unused time you have paid for is refunded.
Law and disputes
Polish law applies, and if you are a consumer you keep the protection of the mandatory law of the country you live in. Please email us first — most things are a misunderstanding and take one reply to fix.
If that does not settle it, a consumer in Poland can ask their local consumer ombudsman (powiatowy or miejski rzecznik konsumentów) or the provincial Trade Inspection (Wojewódzki Inspektorat Inspekcji Handlowej) for free help, and a consumer elsewhere in the EU can go to the European Consumer Centre for their country. We are not currently signed up to any particular out-of-court dispute resolution body, and either of us can go to the ordinary courts.
Changes to these terms
We change these terms only for a real reason — a change in the law, in how payments work, or in what the app does. When we do, the date at the top changes, and if you have an account we email you at least 30 days before the change takes effect, saying what changes.
If you don't agree, you can cancel your plan or delete your account before then, at no cost, and any time you have already paid for beyond that date is refunded. A change never applies to a period you have already paid for without your agreement.
